Paid Service Terms and Conditions - Latest
Effective Date: October 11, 2024
Article 1 Purpose
The purpose of these Terms and Conditions is to stipulate the terms and conditions of use and procedures for various paid services provided by OverTheHand Co., Ltd. (hereinafter referred to as the “Company”) through the MASCOZ website (https://www.mascoz.com/ ), operated via the internet, mobile applications, etc.
Article 2 Enforcement and Modification of Terms
The content of these Terms and Conditions becomes effective on the specified effective date, once publicly posted on the website, service screens, or communicated to users via email, with user consent.
The Company may amend these Terms and Conditions to the extent that such modifications do not violate applicable laws, including the Consumer Protection in Electronic Commerce Act (hereinafter the “E-commerce Act”), the Act on the Regulation of Terms and Conditions (hereinafter the “Terms and Conditions Act”), the Act on Promotion of Information and Communications Network Utilization and Information Protection (hereinafter the “Network Act”), and the Contents Industry Promotion Act (hereinafter the “Contents Act”).
Matters not specified in these Terms and Conditions shall be governed by the Basic Telecommunications Act, the Telecommunications Business Act, the Network Act, and other relevant laws.
When amending these Terms and Conditions, the Company will specify the application date and reasons for the amendment alongside the current Terms and Conditions on the homepage’s main screen at least seven days (or 30 days if unfavorable or significant) prior to the application date, and will notify existing users via their latest registered email or SMS with details of the amended Terms and Conditions.
Users have the right to refuse any amendments to the Terms and Conditions in whole or in part. Users with Grievance to any amendments may terminate their service agreement by withdrawing their membership. However, terminating the agreement will result in loss of access to member-exclusive services.
If a user does not explicitly express their rejection of the amended Terms and Conditions within 10 days (or 30 days if significant or unfavorable) of the application date, the user is considered to have accepted the changes.
Article 3 Supplementary Rules
For matters not explicitly stated in these Terms and Conditions, additional user agreements, the Company’s policies, and relevant laws and regulations shall apply.
Article 4 Definitions of Terms
Definitions of terms used in these Terms and Conditions are as follows:
Paid Service: Goods or services available for purchase through payment methods provided by the Company, with detailed types and content outlined on each purchase page.
Automatic Payment: A service that charges the registered payment method automatically, allowing for continuous service usage.
Cancellation of Subscription: The act of canceling the purchase of unused goods or services within the Paid Service.
Purchase: The act of paying for the Paid Service provided by the Company.
Refund: The process of returning the amount paid for Paid Service in cash or receiving a refund for a canceled purchase.
COZ: Virtual data used for services or purchases, purchased by members for a fee.
Interaction Points: Virtual data used for interactive play within the service, purchased separately from COZ.
Cyber Points: Non-monetary virtual data provided for free by the Company for efficient service usage, without any intrinsic value. Free Interaction Points and Free COZ are classified as Cyber Points.
Other terms used in these Terms and Conditions shall follow relevant laws and customary practices, unless specified otherwise.
Article 5 Posting of Paid Service Details
The Company will display the following information on the corresponding Paid Service information or purchase screen for users' ease of understanding:
Name, type, and content of the Paid Service
Price, payment method, and timing of the Paid Service
Method, timing, and duration of the Paid Service
Conditions and methods for withdrawal and cancellation of the service contract
Contract termination and applicable procedure for ongoing contracts
Conditions and procedures for exchange, return, and refund of services
Technical requirements for services that can be supplied electronically
Details on user compensation, complaints, and dispute resolution with the Company
Transaction-related terms
Additional charges to be borne by the user, if applicable
If the user is a minor, notice that the contract may be canceled without the legal guardian's consent
Paid services provided by the Company are immediately credited to the user's ID upon purchase and can be used based on the Paid Service duration.
The Company offers services for downloading necessary updates and checking PC specifications for service use.
Article 6 Establishment of Service Agreement
The service agreement is established when the user agrees to these Terms and Conditions and purchases Paid Service using the payment methods designated by the Company.
Article 7 Purchase of Paid Services
Users must have a MASCOZ account to purchase Paid Services.
Paid Services can be purchased through the payment methods provided by the Company, including mobile phone, KT Phone Bill, credit card, culture gift certificates, and book vouchers. Users must follow the procedures set forth by the payment provider before using any external payment method. Payment is deemed to be made according to the payment provider's procedures and terms and conditions.
Article 8 Payment Approval
The Company may reject or later cancel approval of any service application under the following conditions:
Failure to pay or verify the payer of service fees
Applications by minors under 19 without legal guardian consent
Applications judged as unapprovable due to the applicant’s fault
Applications violating laws, public order, morals, or Company policies
If approval restrictions apply, the Company may withhold approval until the reason for restriction is resolved, such as insufficient service facilities or service system issues.
Users may request cancellation of payment approval within the specified timeframe if the Paid Service is unused. For specific payment method deadlines, users may contact customer support.
Article 9 Service Usage Period
Paid Services must be used within five years from the last usage date; otherwise, they will expire after five years from the last usage date based on the commercial statute of limitations. If shorter statutory expiration applies, it will prevail.
Article 10 Cyber Points
The Company may provide free Interaction Points and COZ based on usage history, which may expire if unused within a specified period.
Users can request correction of any error in point accumulation within a reasonable timeframe, which will be verified by the Company.
The Company may adjust, retrieve, or terminate Cyber Points periodically for operational, business, or technical reasons. The Company will give one month's prior notice for any adjustment.
Article 11 Beta Services
The Company may provide beta services for a specified period.
Beta services may include data modification, addition, or deletion for stability. Points, avatars, and data related to beta services may be reset after the test period.
Article 12 Payment by Minors
Users under 19 must obtain consent from a legal guardian before purchasing Paid Services. If consent is not obtained, Paid Services cannot be used.
For consent, legal guardians may use mobile verification, i-PIN, or fax, and will be notified of consent status and details via email.
Legal guardians can choose consent validity periods and will be notified 30 days before expiration to confirm extension.
Article 13 Grievance
Users may raise Grievance regarding Paid Services or payments through customer support.
The Company will investigate within 10 days and notify the user of the results.
If notification cannot be made within the specified period, the Company will inform the user of the reasons and rescheduled handling date.
Article 14 Right of Withdrawal
Users may exercise their right to withdraw from the purchase of Paid Services in accordance with applicable laws, subject to the following limitations:
If the Paid Service has been used and its value is significantly diminished as a result.
If the Paid Service is damaged or lost due to the user's negligence.
If the Paid Service's validity period has expired.
If the Paid Service has already commenced (exceptions may apply for partially provided services, where unused portions may still be eligible for withdrawal).
Users must exercise their right of withdrawal within seven (7) days from the date of purchase.
If the Paid Service is materially inconsistent with its advertised description or contractual terms, users may withdraw within three (3) months from the date of provision, or within thirty (30) days from the date the discrepancy was discovered or reasonably should have been discovered.
Users may notify their intention to withdraw either orally or in writing (including electronic communication).
The Company will provide multiple methods for withdrawal to facilitate the user's exercise of this right, beyond the method used for the initial purchase.
In cases of dispute, the Company bears the burden of proof regarding user liability or the provision of the service.
Withdrawal may require the return of the Paid Service, with the user bearing the associated costs unless the withdrawal is due to the Company's fault.
Refunds will be processed within three (3) business days of receiving the returned service, or upon confirmation of the user's withdrawal request if no return is necessary. The Company will pay interest on any delayed refunds in accordance with applicable laws.
The Company will not impose penalties or claim damages against the user solely for exercising their right of withdrawal.
Article 15 Termination of Agreement
The Company or users may terminate Paid Service contracts for agreed or legally specified reasons.
Users may terminate if service delivery is incomplete after a reasonable period unless a deadline is essential.
Article 16 Effects of Termination
Upon termination, users must return services, and the Company will refund payments plus interest if delayed.
After termination, contractual obligations cease, but users may be refunded pro rata.
Article 17 Prohibition on Transfer
User rights cannot be transferred, donated, or used as collateral.
Article 18 Refund
Refunds may be processed within three business days of request using the original payment method.
Specific refund methods apply to gift certificates, streaming services, and subscription services.
Refunds are unavailable for used services, low-balance services, and deactivated accounts.
Article 19 Refund of Overpayments
Overpayments will be refunded using the original payment method.
Refunds may offset outstanding payments due.
Article 20 Compensation for Service Service Malfunctions
Major service defects will be compensated appropriately.
If a prior notice is absent, compensation will apply per contract provisions.
Article 21 Limitation of Liability
The Company is exempt from liability due to force majeure events.
The Company is not responsible for user-related service disruptions unless due to Company fault.
Article 22 Jurisdiction
Any dispute shall be amicably resolved between the Company and users.
Unresolved disputes shall be determined per the Civil Procedure Act.
Korean law applies to the interpretation and application of these Terms and Conditions.
